III. Authentication and the posture of this case: It is still a Motion to Dismiss.
.............Defendants fecklessly cite: Carmona v. Toledo, 215 F.3d 124, 131 (1st Cir. 2000) “To be admissible at the summary judgment stage, documents must be authenticated by and attached to an affidavit that meets the requirements of Rule 56(e).”
.......In case the Defendants need a reminder, we are not arguing a Summary Judgment motion, although at this point the Defendants are getting the benefit of substantial discovery against Plaintiff while their removal and Motion to Dismiss has removed his opportunity to obtain one whit of discovery.
...........Now Defendants seek to invalidate the use of any video materials the relevant portions of which are clearly authenticated because it is obvious that Plaintiff was rolling the video . At the hearing for Disclosure Plaintiff will then properly swear Under Oath that any and all campaign event video and stills were taken by him, that he has been in exclusive custody of same, and that the video has not been digitally altered. Once again, it is a Motion to Dismiss at this point, but Plaintiff does certainly look forward to the Summary Judgment phase at which point he will move for it pursuant to NAACP v. Thompson, 648 F.Supp. 195 D.Md.,(1986).
