The Constitution of the United States is designed to limit the power of the government without detracting from its effectiveness. Governments get their power from the people whom they represent. That is to say, if the people do not grant it, the government has no power at all.
The Bill of Rights, which includes the first ten amendments to the U.S. Constitution, details citizens’ rights and freedoms under the government’s rule. It protects the people from government having too much power, in other words, it limits the federal power. Americans have freedom of speech, press, religion and assembly. They have the right to bear arms and to have the privilege of a fair and speedy trial in a court of law.
This way of limiting government power goes hand in hand with the system of checks and balances that is set up through the three branches of government: legislative, judicial and executive. The three separate branches are each responsible for different aspects of the administration, and no one branch can function without the approval of the others. In this way, they are required to cooperate to maintain a fully functioning government. Two branches always have the authority and responsibility to override the third. No government branch or official has the ability to act unconstitutionally. The Constitution establishes government to protect and serve citizens but simultaneously protects citizens from its rule.
Furthermore, the federal government relegates some of its authority to the smaller, individual state administrations. This decentralization is another way of limiting the power of the national government without reducing its ability to perform its essential functions. Distribution of power is preferable because if one part of the system breaks down, another can pick up the slack to maintain order. No one person or organization can become too powerful, protecting the nation against tyranny and also being sure to represent the widest range of interests among the population.
