Malice aforethought can be defined as a legal term of art that comprises the following types of murder: intentional murder, grievous-bodily-harm murder, felony-murder, and depraved heart murder. In intention to kill murder, for a person to proven guilty, he or she must have committed the act that results in death along with intentions and foresight that the action may result in the death of another person. In grievous-bodily-harm murder, death results, when someone is, attacks another one with an intention to cause grievous bodily harm such as an individual fatally stabbing another one with an intention of only causing bodily harms. Felony murder results when death occurs while in the process of committing a felony. Depraved heart murder is killing someone in a manner that shows a disregard for the value of human life. Attempted murder occurs when a person has an actual intent to kill another one and takes a step towards the commission of that murder. It is a very serious crime, and for one to be convicted, a prosecutor must be able to prove the following in a court of law. Deliberate behavior that disrespects human life, an objective to actually kill someone, and considerable evidence that relevant steps were made to kill a victim (Emsley, 2006)
In Mr. Assin’s case, if he could have been found guilty, his crime would have been considered as violent crime since he was to cause bodily harms and death. Crime of violence results to causing of bodily harms or even death while crime of property is taking someone’s property with force and at a time, bodily harms may result if the victim is not cooperating with the robber. Crime of violence can be exemplified when thugs attack a family with the intent of only causing bodily harms or death to the victims. Crime of violence is illustrated when burglars break into private properties such as a home or shop and make way with goods or property.
Both crimes of violence and crime of property are serious crimes, but the difference is illustrated when one is being convicted. An individual who has committed crime of property is likely to receive a light penalty because the court has to analyze circumstances that led to that person committing such a crime (Simpson, 2010). In such circumstances, such an individual might have been forced to commit that crime hence he or she is likely to receive a light penalty. Such scenarios are the one making crime of property to be less serious than crime of violence. Crime of violence is considered to be serious because one causes bodily harms without the will of a victim. It may lead to death hence the criminal lacking any respect for human life. In conclusion, both crimes are serious but the degree of that crime is the one differs.
