The most important ethical case is that of Enron. This case is so important in business ethics in the present day as it impacts directly on the acts of management. This case reflects the impacts that false information may have on shareholders. It also offers valuable lessons to management and members of staff who wish to engage in illegal manipulation of financial statements. The management of today and those of the future will learn from this case.

Answer 2

The family of the deceased cannot sue and if they sue cannot be awarded damages for defamation of the deceased. The rationale is that when an individual dies, he ceases to exist. The fact that he is non-existence makes it impossible for anyone to lodge a claim of damages on his or her behalf it is therefore impossible to attempt and imagine that one would accrue damages that arise out of a defamation case of a dead person.

Answer 3

The responsible Corporate Officer Doctrine extension to the administrators of corporations is a good thing and should be encouraged in the recent years. The principle behind this argument is that the administration may take advantage of the reality that a corporation is a distinct legal entity from the management and engage in activities that harm the public. This doctrine ensures that the management adheres to the rule of law and maintains the operations of the corporation in a legal way.

Answer 4

Affirmative defense should be available in other types of cases and not limited to sexual harassment cases. The reason why this is advised is that some employers perceive themselves to be untouchables and may mistreat the weak defenseless employees. These employees may be innocent but may not get justice as the bosses may manipulate the court cases. Therefore, ensuring that they are answerable and have the burden of proof ensures justice. Affirmative defense therefore should be advocated for in other cases.
