The 4th Amendment has 2 legal concepts. They are the law’s prohibition against unfair seizures and searches and its requirement when it comes to probable cause in terms of issuing a warrant. These two are significant because every person has the right to defend himself against unfair searches, which he will not be in favor of having his personal property to be seized unreasonably. In that case, law enforcers must first obtain a search warrant unless there is an existing allowable exception. Also, an individual cannot be arrested or be searched unless there is a probable cause, which met its requirement. These two will reduce the possibility of abuse in authority.
What is meant by the phrase “coercion can be mental as well as physical”? What role does the concept of “mental coercion” play in Chief Justice Warren’s opinion?
The term refers to the intimidating acts of law enforcers against anyone who is an alleged criminal, which means that such coercion also affects a person psychologically. The mental coercion concept made Chief Justice Warren to say that interrogating an accused without knowing his constitutional rights and his right to self-incrimination would force him to confess in a coercive manner. Therefore, the suspect must be aware and told that they do not have to answer the questions given the police officers.
In your opinion only, where is the disconnect meaning we tell children one thing so why are we not following our own advice?
We normally give advice to children, but in reality, it is we who cannot follow such advice in the first place. The disconnect goes to the reality that it is easier for us to give advice to a person younger than us, but we find it hard to apply such advice to ourselves. It will be corrected once we already know and understand how to take advices of our own.
