The purpose of this Memorandum is to give suitable suggestions from legal perspective that is required to update the Loss Prevention/Human Resource Manual (the “HR Manual”). I will deal with the following areas of law for the purpose of this manual, namely (a) The Employment Standard Act, 2000 (ESA) (b) Judicial position relating to disciplinary proceedings, constructive dismissal and fair hearing, and (c) Judicial position on the Human Rights Code.
