While signing up a contract, both the employee and the employing body make a truce, rather a legal agreement that the former would have liberty to use the information or at least have it, however, personal it might be. First thing that needs to be known here is that why is it required at the first place? The answer is simple, to use the information against the employer if need be, having said that, if the employing body has to follow the person after having gotten hurt by them. Government similarly keeps information in the form of registrations and licensing once again for the same person, to reach out to them. All in all, the government and privately working employing bodies enjoy the rights to know everything about their employees for their own comfort, safety, and insurance.
It is logically legal to use information of employees against them as part of the provision of security to the employees and to serve as a source of transparency on the end of the employees. However, the question is whether it should be. The first problem that arises in this argument is that of privacy of the employee. He too enjoys the right to privacy but for only as long as it has nothing to do with the bigger benefit i.e. the benefit of the government and the interest or security purposes of the employing private body (PRIV, 2004).
There is a dilemma that whether the right of privacy enjoyed by employees should be kept above and respected more than the right of organizations to manage them. Saying this would mean that a manager finds his subordinate working for another company at the same time of being in contract with them that forbids them from it must not do anything about it. This is clearly an irrational thing to say and would be unsurprisingly unbearable for the manager. There are no clear demarcations about till what point can the employees save their information from reaching such hands. Social websites have much information displayed by individuals that strengthen the belief of organizations that the same information can be used against them, as it is visible to all anyways. Even if it is not, still they have a very sound reason for knowing who the other person is and has been before they offer him or her job.
Coming to legal capacity and worth of information extracted from social web sites, there is really no guarantee about how seriously can they be taken. People use fake information on social websites quite frequently, and there is no law that says they can’t. Under these circumstances, there is no credibility of such information. Likewise, there are possibilities of altogether fake accounts of employees who would not know about even their existence. But, it is undeniable that to stay safe from fraudulent activities the government and employers find it necessary to use personal information of employees from the social accounts if need be.
In my views, it should be legal for the government and employers to be able to track and keep an eye on information displayed on social accounts. However, the recommendations are to make adequate disclosure firstly. The collection of personal information should be added to the employment contract as a clause that has to be satisfied before getting employed. Then the purpose should be stated clearly so that the employee or citizen does not feel his personal life being breached just for the fun of it. Also, only the required information has to be considered worth collecting and using (Guide, 2014).
Social websites are being used for investigation purposes very commonly by civil and military intelligences around the world. There is a huge benefit in the hand of government at least known as the “need of time” to breach a person’s privacy. If Interpol and FBI can break into a person’s house by having gotten intelligence report of a “possibility” of involvement in crime, then they can by all means break into someone’s social account. The information given in the websites either displayed or not, is in all cases visible to the website management so if it can be shared with them then so can it be with the government as part of a good gesture of helping the government in social protection (Presson, 2003). Even the privately operating employers can use the information by, of course first presenting the employees with the option to either care sharing the information or to leave the position. This would leave the decision to employees to make whether they consider the corporation at hand worthy or not.
